End User License Agreement

1. Introduction

This End User License Agreement ("EULA") is a legal agreement between you ("User", "you") and Royal Care AU Pty Ltd (ABN 76 684 189 320), trading as Royal Care Tech ("Licensor", "we", "us") for the use of SYNK software applications ("Application"), including but not limited to CallSYNK, TextSYNK, NoteSYNK, InvoiceSYNK, ShiftSYNK, BizSYNK, ChargeSYNK, SignSYNK, MapSYNK, mySYNK, and any associated updates, patches, or supplements.

By installing, copying, or otherwise using the Application, you agree to be bound by this EULA. If you do not agree, do not install or use the Application.

2. License Grant

Subject to the terms of this EULA and payment of applicable fees, we grant you a:

• Limited — restricted to the scope described in this EULA
• Non-exclusive — we may license the Application to others
• Non-transferable — you may not transfer this licence to another person without our consent
• Revocable — we may revoke this licence if you breach this EULA

licence to download, install, and use the Application on devices that you own or control, for your personal or internal business purposes.

3. Device Permissions

Certain Applications require access to device features to function as intended. By installing and using the Application, you acknowledge and consent to the following permissions where applicable:

You may revoke any permission at any time through your device settings. Revoking permissions may limit the functionality of the Application.

4. Restrictions

You may not:

• Copy, modify, or distribute the Application or any part of it
• Reverse engineer, decompile, disassemble, or attempt to derive the source code
• Rent, lease, lend, sell, sublicense, or transfer the Application to a third party
• Remove, alter, or obscure any proprietary notices, labels, or marks
• Use the Application to develop a competing product or service
• Use the Application in any way that violates applicable laws or regulations
• Use automated systems or bots to interact with the Application

5. Subscriptions and In-App Purchases

Some Applications offer free tiers with optional paid subscriptions or in-app purchases. Where applicable:

• Payment is processed through the platform provider (Google Play, Apple App Store) or our direct payment processor
• Subscriptions auto-renew unless cancelled before the renewal date
• You can manage or cancel subscriptions through the platform's subscription management settings
• Free trial periods convert to paid subscriptions at the end of the trial unless cancelled

Platform-specific refund policies (Google Play's refund policy, Apple's refund policy) apply to purchases made through those platforms.

6. Updates and Changes

We may release updates, patches, or new versions of the Application from time to time. Updates may:

• Add new features or modify existing ones
• Fix bugs and security vulnerabilities
• Change system requirements

Some updates may be required for continued use of the Application. Where possible, we will notify you of significant changes before they take effect.

7. Intellectual Property

The Application, including all code, graphics, interfaces, content, and documentation, is owned by Royal Care AU Pty Ltd (ABN 76 684 189 320), trading as Royal Care Tech and protected by Australian and international intellectual property laws.

This EULA does not grant you any ownership rights. You receive only the limited licence described in Section 2.

Your data and content remain your property. See our Terms of Service (Section 6) for details on data ownership.

8. Privacy and Data

Your use of the Application is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your information, including device permissions and sensitive data handling.

By using the Application, you consent to the data practices described in our Privacy Policy.

9. Disclaimer and Limitation of Liability

To the maximum extent permitted by applicable law:

• The Application is provided "as is" and "as available" without warranties of any kind, except those that cannot be excluded under law
• We do not warrant that the Application will be uninterrupted, error-free, or free from security vulnerabilities
• Beta and Early Access features are provided for testing purposes and may not perform as described

Australian Consumer Law: Our Applications come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in this EULA excludes, restricts, or modifies any consumer right that applies under the ACL. If the Application fails to meet a consumer guarantee, you may be entitled to a remedy.

Subject to the above, our maximum liability is limited to the amount you paid for the Application in the 12 months preceding the claim.

10. Termination

This EULA is effective until terminated. It terminates automatically if you fail to comply with any term. Upon termination:

• You must stop using the Application and delete all copies from your devices
• You may export your data before deletion (we allow 90 days for data export)
• Provisions relating to intellectual property, liability, and governing law survive termination

11. Third-Party Services

The Application may integrate with third-party services (e.g., Google Calendar, Xero, MYOB). Your use of those services is governed by their respective terms and privacy policies. We are not responsible for third-party services or their handling of your data.

12. App Store Terms

If you downloaded the Application from Google Play Store or Apple App Store, you acknowledge that:

• This EULA is between you and Royal Care AU Pty Ltd (ABN 76 684 189 320), trading as Royal Care Tech (not Google or Apple)
• The platform provider has no obligation to provide maintenance, support, or warranty for the Application
• The platform provider is not responsible for any claims related to the Application
• The platform provider is a third-party beneficiary of this EULA and may enforce it against you

13. Governing Law

This EULA is governed by the laws of the State of Victoria, Australia. Disputes are subject to the non-exclusive jurisdiction of the courts of Victoria.
